These Terms & Conditions ("Terms") govern your use of capecorallocaldeals.com and the services of Cape Coral Local Deals ("Cape Coral Local Deals," "we," "us," or "our"), a service of ML Media Consultants, Inc. By using the website, listing a business, reserving a mailer spot, or signing up for deals, you agree to these Terms. If you do not agree, please do not use the service.

1. What We Offer

• A free online directory of local businesses serving Cape Coral, Florida.
• A shared, oversized community mailer ("the Mailer") with advertising spots sold to local businesses and mailed to Cape Coral households through the U.S. Postal Service Every Door Direct Mail program.
• Deal emails for homeowners who sign up.

Features, pricing, and availability may change.

2. Eligibility

Sizes and placement: Spot sizes and positions are not fixed to a category. Advertisers may choose from the available sizes, and we may adjust spot positions and the category mix until the Mailer is full. Final placement is set once enough spots are sold.

You must be at least 18 and, if you act for a business, have authority to bind that business to these Terms.

3. Free Directory Listings

• Listing a business in the directory is free and open to all eligible local businesses.
• Optional upgrades: Paid listing upgrades (link, $9.99 per month; logo and link, $19.99 per month) are billed monthly when you sign up, renew automatically each month, and can be cancelled at any time. Cancelling stops future charges. Basic listings remain free. Buying a mailer spot includes one year of the Featured ($19.99 per month) listing at no charge, starting when you sign up; after that year it ends unless you choose to continue it. Featured Listings are shown above free listings in their category.
• Directory listings: The directory may include publicly available business information, such as a business name and address. A business owner may claim, update or ask us to remove a listing at any time by emailing [email protected].
• We may review, edit, decline, or remove any listing at our discretion, including listings that are inaccurate, misleading, unlawful, or not a good fit for the directory.
• Directory listings and the Mailer are separate. Appearing in the directory does not reserve a spot on the Mailer.

4. Mailer Spots

• Category exclusivity: Each spot on the Mailer is limited to one business per category for that mailing (restaurants are divided by cuisine, such as American, Mexican, Chinese/Asian, and Italian/Pizza). Exclusivity applies only to the Mailer and only for the mailing you purchase. It does not apply to the directory, and it does not guarantee a spot in later mailings.
• Signing up: Spots are first come, first served. Your spot and category are secured when you sign up and pay. We set the print and mailing dates once enough spots are sold, and we will tell you the dates.
• Nothing prints until enough spots are sold to cover the cost of printing and mailing. If we do not reach that, we will cancel or postpone the mailing, and if we cancel, you will receive a full refund of any amount you have paid.
• Mailing timing: Mailing dates depend on printing and Postal Service schedules and are not guaranteed. The Postal Service controls delivery timing, and we cannot guarantee that any particular household receives or reads the Mailer.
• Pricing: The price for each spot is shown on the website or in your order. Prices are for the spot and mailing described, and may change for future mailings.
• Payment: Payment is due when you sign up. If payment is not received, we may release your spot to another business.
• Refunds: Once the Mailer has been sent to the printer, payments are non-refundable except where required by law or where we fail to mail the Mailer.
• Design: We may help format your ad. You are responsible for approving your final ad proof. Once you approve it, we are not responsible for errors in the approved content.

5. Your Content and Offers

• You represent that your business information, offers, coupons, logos, photos, and other content are accurate, lawful, and yours to use, and that they do not infringe anyone else's rights.
• You give us a non-exclusive, royalty-free license to use, reproduce, display, and distribute your content in the directory, on the Mailer, on our website, in emails, and in marketing for Cape Coral Local Deals.
• You are solely responsible for honoring every offer and coupon you publish, for stating its terms and expiration clearly, and for complying with all laws and licensing requirements that apply to your business.
• You may not advertise anything illegal, deceptive, or harmful, or anything we reasonably decide is inappropriate for a family mailer. We may reject or remove any content or ad.

6. Homeowners

• Signing up for deal emails is free. You can unsubscribe at any time using the link in any email.
• Offers are provided by the participating businesses, not by us. We do not endorse or guarantee any business, product, or service, and we are not a party to any transaction between you and a business. Please confirm offer terms with the business.

7. Communications

By submitting a business form, you agree we may contact you about your listing and mailer spots by email, phone, and text. By signing up as a homeowner, you agree to receive deal emails. You can opt out at any time by replying STOP, using the unsubscribe link, or contacting [email protected]. Our Privacy Policy explains how we handle your information.

8. Prohibited Uses

You may not use the website or service to violate any law or another person's rights, submit false or misleading information, impersonate another person or business, send spam, interfere with the site's operation, scrape or copy the directory in bulk, or attempt to gain unauthorized access.

9. Intellectual Property

We own the Cape Coral Local Deals name, logo, website, Mailer design, directory, and related materials. You may not copy or reuse them without our written permission. You keep ownership of your own content.

10. No Guarantee of Results

Advertising results depend on many factors outside our control, including your offer, pricing, seasonality, and customer behavior. We do not guarantee leads, sales, redemptions, revenue, profit, or any specific results from the directory or the Mailer.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the website and services are provided "as is" and "as available," without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the website will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Cape Coral Local Deals, ML Media Consultants, Inc., and their owners, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities. Our total liability for any claim relating to the service will not exceed the amount you paid us for the affected mailer spot.

13. Indemnification

You agree to defend, indemnify, and hold harmless Cape Coral Local Deals, ML Media Consultants, Inc., and their owners, officers, employees, and contractors against third-party claims, losses, and reasonable costs arising from your content, your offers, your products or services, your violation of law, or your breach of these Terms.

14. Third-Party Services

We rely on third-party providers, including website, email, payment, printing, and postal services. We are not responsible for their outages, delays, errors, or policy changes.

15. Suspension and Termination

We may suspend or remove a listing, ad, or account at any time if we believe these Terms have been violated or that it is necessary to protect the service, advertisers, or residents. You may ask us to remove your directory listing at any time.

16. Changes

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Continued use after an update means you accept the revised Terms.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any legal action relating to these Terms must be brought in the state or federal courts located in Miami-Dade County, Florida, unless the law requires otherwise.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a sale or restructuring of the business. These Terms and our Privacy Policy are the entire agreement between you and us about the service.
